TheOhioStateUniversitylaunchedalegalchallengeagainstaMichigancompany’sattempttotrademarkaphrasethatcutsdirectlyintooneofcollegefootball’smoststoriedrivalries.TheuniversityfiledanAug.27noticeofoppositionwiththeUnitedStatesPatentandTrademarkOfficetocontestanapplicationbyAnnArborrestaurantTheBrownJug,Inc.Thebusinessisseekingtotrademark“BuckeyeTears”forusewithbeerandliquorproducts.
Initsfiling,OhioStatesaidthemarkcouldconfuseconsumersintothinkingtheuniversitywasconnectedtotheproducts.Theschoolcitedthevalueofitsbrand,pointingoutthatitslicensingprogramgeneratedmorethan$145millioninroyaltiesandroughly$2.2billioninretailsalesoverthepastdecade.Universityattorneysalsoarguedthatassociatingalcoholwithitsathleticsprogramscoulddamageitsreputationanddilutethestrengthofits“Buckeyes”identity.
