AdividedMichiganSupremeCourtruledThursdaythatlawenforcementauthoritiescannotuseawarranttosearchacriminalsuspect’scellphonewithoutspecifyingwhatitisthey’relookingfor.Thedecisionsetsahigherbarforlawenforcementtoseeksearchwarrantsforcellphones.
Thedefendant,MichaelCarson,waschallengingconvictionsforbreakingintoaneighbor’ssafe,larceny,receivingorconcealingstolenproperty,andconspiracy.PartofthecaseagainstCarsonwastextmessagesobtainedasaresultofasearchwarrantonhiscellphone.
Onappeal,Carsonarguedthewarranttosearchhiscellphonewastoobroad,violatinghisFourthAmendmentrights,andthathisattorneyshouldhavedoneabetterjobofworkingtosuppressthatevidence.
AslimcourtmajorityruledwithCarsonthatthewarrantviolatedhisrightsagainstunreasonablesearchandseizure.
